1535년 7월 1일, 영국의 대법관 토마스 모어 경이 재판관들 앞에서 기소장의 낭독을 들었다.
On the 1st July 1535, Master Thomas More, Chancellor of England, was brought before the judges and the accusations against him read in his pres­ence.
대법관 노포크 공작이 그를 향해 말했다."모어 경, 경은 왕에게 큰 잘못을 범했소. 그러나 경이 그토록 열렬히 신봉하던 추악한 주장을 뉘우치고 고친다면 청원하여 사면할 작정이오"
The Chancellor and the Duke of Norfolk turned to him and said, "You, Master More, have gravely erred against the King; nevertheless we hope by his clemency that if you repent and correct your obstinate opinion in which you have so rashly persevered, you will receive pardon."
모어 경은 "대감, 대감의 온정에 진심으로 감사드립니다. 신은 하느님께 제 정견을 죽기로써 지켜주십사 기도드립니다. 특히 제 옥중생활과 악화된 건강을 감안하면 말이나 기억 그리고 판단력이 그런 장문의 기소장에 대한 답변을 그르칠까 우려되오"라고 답변했다.
He replied, "My Lords, I thank you very heartily for your good will. I pray God preserve me in my just opinion even to death. As to the accusation against me, I fear words, memory, and judgment would alike fail me to reply to such a length of articles, especially considering my present imprisonment and great infirmity." 
그러자 의자가 놓여지고 모어 경의 답변이 이어졌다. : "기소장의 첫번째 항목은 신이 폐하(헨리 8세)의 재혼을 항상 악의적으로 반대했다고 것인데 이에 대해 신은 양심에 따라 말한 것뿐이라고 답변하겠소. 진실을 감출 생각은 전혀 없소이다. 그랬다면 마땅히 반역자가 됐을 것이오. 만일 그것이 잘못이라고 한다면, 그 잘못때문에 무기징역형에 처해졌고 이미 15개월 동안 고통을 겪었으며 재산까지 몰수당했소이다"
A chair was then ordered to be placed for him, and he proceeded as follows: "As to the first article, charging me with having always maliciously op­posed the King's second marriage, I will only answer that what I have said has been according to my conscience. I never wished to conceal the truth, and if I had, I should have been a traitor. For this error, if error it should be called, I have been condemned to perpetual imprisonment, which I have already suffered for fifteen months, and my goods confiscated. 
이런 이유로 신이 옥중에 있을 당시 지난 의회에서 입법된 법령의 처벌조항을 범했다는 주요 혐의에 대해서만 답변하겠소. 시종장과 의회에 신이 답변한 것을 증거로 왕의 수장권 부여를 거부했다는 혐의인데 신은 이 세상에 이미 죽는 몸이므로 그런 것들은 관심이 없고 그리스도의 수난만이 내 관심사였소이다.
For this rea­son I will only reply to the principal charge against me, that I have in­curred the penalty of the Statute made in the last Parliament since I was in prison, by refusing to the King his title of Supreme Head of the Church, in proof of which you allege my reply to the Secretary and Council, that as I was dead to the world, I did not care to think of such things, but only of the passion of Christ. 
신의 답변은 이렇소. 그러한 내 침묵에 대해 경들이 제정한 법률로는 처벌이 불가능하오이다. 영국법이나 이 세상의 어느 법도 말이나 행위가 없으면 즉 침묵한다고 처벌하지는 않기 때문이오"
I reply that your Statute cannot condemn me to death for such silence, for neither your Statute nor any laws in the world punish people except for words or deed, surely not for keeping silence." 
이에 왕의 대리인은 그런 침묵은 법률에 대한 악의를 나타내는 확증이며 특히 법률에 대한 질문에 모든 충신들은 법률의 선익을 명백하게 답변할 의무가 있다고 말했다.
To this the King's proctor replied that such silence was a certain proof of malice intended against the Statute, especially as every faithful subject, on being questioned about the Statute, was obliged to answer categorically that the Statute was good and wholesome. 
모어 경은 이렇게 답변했다. "지당한 말씀올시다. 침묵하는 사람은 시인하는 것과 같다는 관습법의 의미가 진실하다면, 신의 침묵은 국법을 능멸하기는커녕 승인하는 것으로 받아들여져야하지요. 대감 말씀대로 모든 충신에겐 답변 의무가 있지요. 허나 신의 말은 충신은 이 세상 무엇보다도 제 양심과 영혼에 더 묶여있지요. 신처럼 양심이 있다면 추문이나 선동을 일으키지 않겠지요. 아울러 단언컨데 신은 생존하는 그 누구에게도 제 양심을 찾은 적이 없소이다."
"Surely," replied More, "if what the common law says is true, that he who is silent seems to consent, my si­lence should rather be taken as approval than contempt of your Statute. You say that all good subjects are obliged to reply; but I say that the faith­ful subject is more bound to his conscience and his soul than to anything else in the world, provided his conscience, like mine, does not raise scandal or sedition, and I assure you that I have never discovered what is in my conscience to any person living.
기소장의 두 번째 항목은 신이 로체스터의 주교(성 요한 피셔)에게 왕명을 거역하라고 권고하는 여덟 통의 편지를 보내 위법을 도모했다는 것인데, 신의 생각으로 이 편지들을 공개적으로 낭독하면 좋았을텐데 경들은 주교님이 그 편지를 태워버렸다고 하니 신이 그 실체를 밝히겠소이다.
As to the second article, that I have conspired against the Statute by writing eight letters to the bishop of Rochester, advising him to disobey it, I could wish these letters had been read in public, but as you say the Bishop has burnt them, I will tell you the substance of them. 
일부 편지는 신과 나눈 오랜 우정과 관련있는 사적 문제들에 관한 내용올시다. 다른 편지는 감옥에서 신이 첫 번째 법률심리에 어떻게 답변했는지를 묻는 주교님께 올린 답신이외다. 신은 양심을 천명했으니 주교님도 그래셔야 한다고 말씀드렸소이다. 맹세컨데 이것이 서신의 요지올시다. 그러니 신을 국법으로 처벌할 수는 없는 것이외다.
Some were about private matters connected with our old friendship. Another was a reply to one of his asking how I had answered in the Tower to the first ex­amination about the Statute. I said that I had informed my conscience, and so he also ought to do the same. I swear that this was the tenor of the let­ters, for which I cannot be condemned by your Statute.
세 번째 항목을 말씀드리면, 종교회의의 심문을 받았을 때, 신은 국법이 양날의 칼과 같아 그것을 인정하는 사람은 영혼을 망치고, 그것을 반박하는 사람은 그의 육신을 망친다고 답변했소이다. 로체스터의 주교님도 같은 답변으로 우리가 연대하고 있음을 보여주셨지오. 신은 조건적으로 대답하였을뿐이지요. 만약 국법이 양날의 칼처럼 양편을 자른다면, 사람이 어떻게 해야 어느 한편에 위험을 초래하지 않게 행동할 수 있겠소이까?
"Touching the third article, that when I was examined by the Council, I answered that your Statute was like a two-edged sword, for he who ap­proved it would ruin his soul, and he who contradicted it, his body; and that the bishop of Rochester answered similarly, showing that we were confederates, I reply that I only answered thus conditionally, that if the Statute cut both ways like a two-edged sword, how could a man behave so as not to incur either danger? 
신은 주교님의 답변이 어떠했는지는 모릅니다만 신처럼 답변하셨다면 우리들이 서로 의견에 동의했기 때문이지 미리 짠 것은 아니올시다. 확언컨데 신은 결코 국법을 악의적으로 행동이나 말로 반대한 적이 없소이다. 아마 폐하에게 이를 악의적으로 보고했을 것이오."
I do not know how the Bishop replied, but if he answered like me, it must have been from the agreement between us in opinion, but not because we had ever arranged it between us. Be assured I never did or said anything maliciously against the Statute, but it may be that this has been maliciously reported to the King."
그러자 재판관들은 형리에 명하여 국가 관습에 따라 12명의 배심원을 소환했다. 이들에게 기소장을 교부하고 모어 경이 악의로 국법을 위반했는지 여부를 판단하게 했다. 
Then they ordered an usher to summon 12 men according to the cus­tom of the country, and these articles were given to them that they might judge whether More had maliciously contravened the Statute.
15분만에 돌아온 그들이 모어 경에게 사형 평결하자 대법관은 "새로운 증언에 따라" 형을 언도했다.
After a quarter of an hour's absence they declared him guilty of death, and sen­tence was pronounced by the Chancellor "selon la lettre de la nouvelle loy."
그러자 모어 경은 다음과 같이 말했다. "형벌을 받은 이래 하느님께서늘 아시지만 신은 양심의 의무로 국법에 대한 자유로운 발언을 바랐소이다. 신이 이 문제를 7년간 궁구한 바로는 유한한 인간도 영혼의 수장이 될 수 있고 되어야 한다는 어느 공인학자의 글을 읽어 본 적이 없소이다."
More then spoke as follows: "Since I am condemned, and God knows how, I wish to speak freely of your Statute, for the discharge of my con­science. For the seven years that I have studied the matter, I have not read in any approved doctor of the Church that a temporal lord could or ought to be head of the spirituality."
대법관은 모어 경을 제지하면서 "무슨 말이요 ! 모어 경은 우리의 주교들과 귀족들보다 경이 더 지혜롭고 양심이 뛰어나다는 말을 듣고 싶은거요? 모어 경은 이에 대해 "대감의 의견을 지지하는 주교 한사람에 대해 신에게는 100명이상의 성인이 계시고, 하느님께서 어떤 부류인지 알고 계시는 경들의 의회가 하나라면 1000년동안 수많은 종류의 공의회가 열렸소이다. 이 왕국이 하나라면 신에게는 프랑스를 비롯하여 전 그리스도교 왕국이 있소이다."
The Chancellor interrupting him, said, "What, More, you wish to be considered wiser and of better conscience than all the bishops and nobles of the realm?" To this More replied, "My lord, for one bishop of your opinion I have a hundred saints of mine; and for one parliament of yours, and God knows of what kind, I have all the General Councils for 1,000 years, and for one kingdom I have France and all the kingdoms of Christendom." 
노포그 공작이 모어 경의 악의가 명백하다고 하자 경은 이렇게 답변했다. "신의 발언은 제 영혼의 만족과 양심을 실행하는데 필요한 것이며, 이를 위해 신은 인간 마음의 유일한 탐지자이신 하느님을 증인으로 청하겠소! 
Norfolk told him that now his malice was clear. More replied, "What I say is necessary for discharge of my con­science and satisfaction of my soul, and to this I call God to witness, the sole Searcher of human hearts. 
더 말씀드리면 국법은 잘못 제정되었소이다. 경들은 절대로 교회에 대항하지 않겠다고 맹세했소이다. 모든 그리스도교회는 하나이고 분리되지 않았소. 모든 그리스도인들의 공통된 동의없이는 법률이나 의회나 종교의회도 그리스도교의 일치를 거스를 권한이 없는 것때문이오. 
I say further, that your Statute is ill made, because you have sworn never to do anything against the Church, which through all Christendom is one and undivided, and you have no authority, without the common consent of all Christians, to make a law or Act of Parliament or Council against the union of Christendom. 
신도 경들이 나를 응징하려는 이유를 잘 알고 있소이다. 신이 왕의 재혼에 결코 동의하지 않았기 때문이지요. 하오나 신은 하느님의 선의와 자비에 희망을 걸겠소이다. 박해를 받은 바오로와 스테파노 두 성인들은 천국에서 친구로 지내시니 비록 다른 세상에 사는 우리를도 서로 완전한 사랑으로 일치될 것이외다. 신은 왕을 지켜주시고 선익한 조언을 받을 수 있도록 하느님께 기도드리겠소"
I know well that the reason why you have condemned me is because I have never been willing to consent to the King's second marriage; but I hope in the divine goodness and mercy, that as St. Paul and St. Stephen whom he persecuted are now friends in Paradise, so we, though differing in this world, shall be united in perfect charity in the other. I pray God to protect the King and give him good counsel."
형장인 타워로 가는 길에서 딸들 중 하나인 마거릿이 궁수들과 경비병들을 밀쳐내고 말도 꺼내지 못한 채로 경을 한동안이나 끌어 안았다.
On his way to the Tower one of his daughters, named Margaret, pushed through the archers and guards, and held him in her embrace some time without being able to speak.
모어 경은 궁수들을 물러나라고 부탁한 다음 딸에게 이것은 하느님의 뜻이니 참고 견디라고 달랬다. 딸은 경의 마음 속 비밀을 오래 전부터 알고 있었기 때문이다.
Afterwards More, asking leave of the archers, bade her have patience, for it was God's will, and she had long known the secret of his heart.
열두어 걸음을 한 후 딸은 되 돌아와 다시 경을 껴안았는데 경은 영혼을 위해 하느님께 기도하라고 당부하는 말만 하였다. 눈물없이는 볼 수 없는 애처로운 광경이었다. 
After going 10 or 12 steps she returned and embraced him again, to which he said nothing, except to bid her pray to God for his soul; and this without tears or change of color.
화요일 경은 타워 앞에서 공개적으로 참수당했다. 죽기 전에 경은 참석한 시민들에게 자신을 위해 하느님께 기도해 달라고 부탁했고 [다른 곳에서] 그들을 위해 마찬가지로 기도하겠노라고 말했다. 그리고 나서 왕이 선익한 조언을 받을 수있도록 하느님께 기도할 것을 간절히 당부했다. 경은 왕의 착한 종이지만 먼저 하느님의 종으로 죽는다고 선언했다. 
On the Tuesday following he was beheaded in the open space in front of the Tower. A little before his death he asked those present to pray to God for him and he would do the same for them [in the other world.] He then besought them earnestly to pray to God to give the King good counsel, protesting that he died his good servant, and God's first.
